1. Grant of License Upon full payment, the Photographer grants the Client a non-exclusive, non-transferable license to use the delivered photographs solely for the purpose of marketing the property photographed. This includes use on MLS listings, real estate websites, social media, and printed promotional materials. 2. Ownership and Copyright All photographs remain the intellectual property of the Photographer. The Client may not sell, license, or distribute the photographs to third parties (including other agents, stagers, builders, or homeowners) without prior written consent from the Photographer. 3. Usage Restrictions The Client agrees to the following restrictions:
Photographs may not be altered beyond basic cropping or resizing without permission. Use is limited to the duration of the property’s listing. Reuse for future listings or other properties is prohibited. No use in commercial advertising, publications, or resale without a separate agreement.
4. Photo Delivery and Retention Photographs will be delivered digitally within [Insert Timeframe] of the shoot. The Photographer will retain the original files for a period of [Insert Duration], after which they may be archived or deleted. 5. Liability The Photographer is not liable for any claims arising from the use or misuse of the photographs by the Client or third parties. 6. Termination Violation of these terms may result in immediate termination of the license and potential legal action. 7. Governing Law This agreement shall be governed by the laws of the state of New York.
